“TERMS”

When an account is created, we need to collect identifying information about you and your vehicle, which is subject to our Privacy Notice incorporated herein. Please review our Privacy Notice and Website Terms of Use. By providing Route 73 Express Car Wash, LLC, a payment method and either accepting these Terms or otherwise utilizing the services, you agree that you have read and understand these Terms.

Services. We offer the following membership plans: Ceramic Wash Package, Premier Shine Wash Package, Extreme Clean & Shine Wash Package, The Wheel Clean Wash Package, and Express Club. For service details and membership fees, please see our on-site staff. We reserve the right to change/cancel membership plans or fees in any manner and at any time as we may determine in our sole and absolute discretion. Individuals under the age of 18 must use the Account of their parent or legal guardian, under such person’s Account, and otherwise subject to these Terms

The services offered may vary and may be affected by a variety of factors, including inclement weather, maintenance, holidays, facility upgrades, governmental orders, or other force majeure events.

By subscribing, you authorize Route 73 Express Car Wash, LLC to automatically charge your credit card or debit card each month on the anniversary date of your initial purchase. This subscription will continue until you cancel it by submitting a request through our website's cancellation form, with at least seven days' notice before your next billing date. No refunds or credits are available for partial periods.

As a member, you may opt-in to receive promotional alerts, updates, and important communications via SMS and email directly from Route 73 Express Car Wash, LLC, Rinsed, Twilio or other affiliated vendors/third parties. By opting in, you consent to receive automated messages to the phone number and email address you provided. Frequency of messages may vary, and message and data rates may apply. You can opt-out at any time by sending "STOP" to the short code for SMS or following the unsubscribe link in emails. See our Privacy Notice.
RFID Sticker. In order to use the plans , an RFID (Radio Frequency Identification Device) sticker must be affixed to the vehicle’s windshield each time services are obtained. You agree not to tamper with, copy, or share a vehicle’s RFID sticker. If the sticker is damaged through no fault of you, we will replace it at no cost. The RFID sticker remains the property of Route 73 Express Car Wash, LLC.

Single Vehicle. Each purchased membership plan is for a single, personal, non-commercial vehicle only. Resale or transfer of any membership plan or RFID sticker to another vehicle or person is expressly prohibited. Please advise Route 73 Express Car Wash, LLC if your car is sold or stolen.

Introductory Period. Introductory or promotional offers may be offered. At the expiration of any introductory or promotional offer period, we will charge the then-current regular price for your chosen plan on your next billing cycle.

Pricing and Taxes. Membership plan pricing is updated on our web site. Plans are subject to sales tax by the State of New Jersey and the cost of the sales tax will be added to the monthly charge automatically. If you wish to change your payment method, please sign into your account and update the required data.

No Refunds. Paid membership plan fees are nonrefundable. Route 73 Express Car Wash LLC will evaluate any refund request as required by applicable law.

No Warranty. MEMBERSHIP PLANS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

Text Messages. Route 73 Express Car Wash LLC may send by automated means transactional communication texts related to your Account and/or your membership plan purchases or your expiring plan. Your mobile carrier’s standard message rates and other charges will apply to any text communication you send or receive. All charges for such text communications are billed by and payable to your mobile carrier. Route 73 Express Car Wash LLC will not be liable for any delays in the receipt of any text communications. Damage Disclaimer. Route 73 Express Car Wash, LLC recommends that you NOT use our services if your vehicle has any one or more of the following conditions: existing damage and loose parts, scratches, automated running boards in lowered position, after market parts, non-removal antennas, loose attachment, broken or chipped windshield. This is only a partial list of items to consider. Each member needs to review their own vehicle. If a member damages Route 73 Express Car Wash LLC equipment or causes an accident on the property or within the wash tunnel, the member shall be fully responsible for all costs of repair or loss of income.

Limitation of Liability. IN NO EVENT SHALL ROUTE 73 EXPRESS CAR WASH LLC OR ITS AFFILIATES OR SUBSIDIARIES OR ANY OF THEIR MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANYONE FOR WHOM YOU PURCHASE MEMBERSHIP PLAN FOR PERSONAL INJURY OR ANY SPECIAL,
INCIDENTAL, PUNITIVE, EXEMPLARY, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER, WHETHER OR NOT THE DAMAGES WERE FORESEEABLE AND WHETHER OR NOT ROUTE 73 EXPRESS CAR WASH LLC WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification. You will indemnify, defend, and hold harmless the Route 73 Express Car Wash, LLC from and against all losses, claims, liabilities, demands, complaints, actions, damages, judgments, settlements, fines, penalties, expenses, and costs (including without limitation reasonable attorneys’ fees) that arise out of or in connection with (a) your misuse of the membership or (b) your breach of these Terms. We reserve, and you grant to us, the exclusive right to assume the defense and control of any matter subject to indemnification by you.
